What is the case about?
This is a proposed class action case. Plaintiffs were employed by Nina Mandelman, D.D.S., Inc. dba Simi Children’s Dental Group. Plaintiffs alleges, in part, that Simi Children’s Dental Group failed to pay them all wages owed. Specifically, Plaintiffs allege that Simi Children’s Dental Group made illegal deductions from wages for rest periods. Under California law, employers must provide nonexempt employees with paid rest periods of 10 minutes for every four-hour work period and that the rest period must be counted as hours worked. Plaintiffs allege that Simi Children’s Dental Group made its employees clock out for their rest periods, and deducted their rest period time from their daily hours worked, which they claim violates California’s minimum wage laws. Plaintiffs further allege that this failure to provide paid rest periods is a violation of California’s rest period laws.
The Plaintiff seek unpaid minimum and overtime wages, rest period premium wages, penalties, and restitution, as well as interest, attorneys’ fees, and costs.
