PAGA Claims Attorney in Ventura, CA
Helping California Workers Enforce Their Labor Rights
The Private Attorneys General Act (PAGA) gives California employees a powerful legal tool to hold employers accountable for widespread Labor Code violations. When an employer’s unlawful practices affect multiple workers, PAGA allows employees to step in and enforce the law on behalf of themselves, their coworkers, and the State of California.
At Strauss & Strauss, APC, our employment law attorneys represent workers throughout Ventura County and across California in PAGA claims. We help employees understand whether PAGA applies to their situation and guide them through each step of the process with clarity and care.
Understanding the Private Attorneys General Act (PAGA)
Enacted in 2004, PAGA was designed to address limited government resources for enforcing California labor laws. The statute authorizes “aggrieved employees” to bring representative actions seeking civil penalties for Labor Code violations that impact the workforce as a whole.
PAGA claims differ from traditional employment lawsuits. Rather than focusing solely on individual compensation, these claims function as enforcement actions on behalf of the state. Under legislative reforms effective June 19, 2024, employees who successfully pursue PAGA claims receive 35% of recovered civil penalties, while the remaining 65% is allocated to the state. These penalties are separate from unpaid wages or other damages that may be available through different legal claims.
Labor Code Violations Commonly Pursued Through PAGA
PAGA applies to a broad range of workplace violations, particularly those involving wage-and-hour compliance.
Common violations include:
- Failure to pay minimum wage or overtime
- Missed or denied meal and rest breaks
- Inaccurate or incomplete wage statements
- Failure to reimburse required business expenses
- Misclassification of employees as independent contractors
- Misclassification of non-exempt employees as exempt
- Failure to pay all wages owed at termination
If your employer’s unlawful practices extend beyond your individual experience, a PAGA claim may be an effective way to seek accountability.
