Understanding the Private Attorneys General Act (PAGA)

Enacted in 2004, PAGA was designed to address limited government resources for enforcing California labor laws. The statute authorizes “aggrieved employees” to bring representative actions seeking civil penalties for Labor Code violations that impact the workforce as a whole.

PAGA claims differ from traditional employment lawsuits. Rather than focusing solely on individual compensation, these claims function as enforcement actions on behalf of the state. Under legislative reforms effective June 19, 2024, employees who successfully pursue PAGA claims receive 35% of recovered civil penalties, while the remaining 65% is allocated to the state. These penalties are separate from unpaid wages or other damages that may be available through different legal claims.
