What is the case about?

This is a proposed class action case. Plaintiffs were Route Sales Managers of Ecolab Inc. working in California. They allege, in part, that Ecolab failed to pay them overtime as required by California law.

The Campos matter follows up on the Icard v. Ecolab matter (also known as Ross v. Ecolab, Inc.), which resolved in 2016, which also involved Route Sales Managers in California.

The plaintiffs seek damages, penalties, and restitution, as well as interest, attorneys’ fees, and costs.

Where is the case pending?

The case is pending in the United States District Court for the Northern District of California as Case No. 54:16-cv-04829-PJH. The case is assigned to the Honorable Phyllis J. Hamilton.

Who is in the class?

The court has not yet certified the class. It is not until such time that the “class” has a legal definition. However, at this time, the putative class is defined as “Each and every person who has worked for [Ecolab] in California as a Trainee Route Sales Manager, 
Trainee Sales Service Route Manager, Route Sales Manager and/or Sales Service Route Manager at any time between August 22, 2012 and the trial of this action…, except for such time period as may be covered by the release in the matter of Ross v. Ecolab, Inc., United 
States District Court for the Northern District of California case 
number C 13-05097 PJH.
