Employer Retaliation for Reporting Time Pay Claim

What if my employer retaliates against me because I told him he owes me reporting time pay?

If you are retaliated against or discriminated against by your employer, you may file a discrimination/retaliation claim with the Labor Commissioner’s Office. You may also file suit against your employer in court. For retaliation and discrimination in any manner, you may file a discrimination/retaliation complaint or file a lawsuit in court. An example of retaliation or discrimination would be if your employer fired you because you threatened to file a reporting time pay wage claim in California.

Example:

Jane believes she is owed reporting time pay. Jane asked her employer to be compensated for reporting time pay and threatened to file a reporting time pay wage claim in California. Jane’s employer refused to pay Jane and retaliated against her by letting her go. Jane is a victim of retaliation and discrimination by her employer. Jane may either file a retaliation/discrimination complaint with the Labor Commissioner or file a lawsuit in court.
